Lead Traveler Acknowledgement

The Lead Traveler (the person responsible for the booking) confirms acceptance of these Terms & Conditions for themselves and on behalf of every member of their group.

In consideration of being permitted to participate in canyoning, climbing, hiking, mountaineering, cycling, and off-road vehicle (4×4) activities organised by Desafio Catita Unipessoal Lda (Madeira Climbing Center), I, the undersigned Lead Traveler, on behalf of myself and all participants in the booking, accept the following:

   Recognition of Risks

   I understand that these activities carry inherent dangers which can lead to serious injury, death, or damage to personal belongings. These hazards include but are not limited to: falling, drowning, hypothermia, slippery surfaces, loose rocks, strong currents, collision, malfunctioning equipment, or the actions of other participants. I voluntarily accept all such risks.

   Physical & Mental Readiness

   I certify that I am in suitable physical and mental condition to safely participate. I confirm I have no medical, psychological, or physical condition that may impair my ability or compromise safety.

3. 3

   Equipment Usage

   Where equipment (e.g. helmets, harnesses, footwear) is provided, I agree to use it properly and return it in good condition. I accept responsibility for any loss or damage resulting from misuse or negligence.

   Personal Responsibility

   I acknowledge that participation is entirely at my own risk. While the Company strives to uphold high safety standards, it cannot guarantee protection from all incidents. I accept that no refund will be issued if I voluntarily leave the activity early.

5. 5

   Adherence to Safety Guidelines

   I agree to follow all instructions and safety guidance provided by the guides. These directions exist for my safety and the safety of others.

   Photo & Video Consent

   While guides prioritise safety, we may share a curated selection of tour photos by email within 24 hours. These may include other participants. By signing this form, I give consent for such use unless I notify otherwise in writing.

7. 7

   Agreement by Lead Traveler

   The person making the booking (Lead Traveler) accepts these terms on behalf of themselves and all individuals in their group. They are responsible for ensuring that all group members understand and accept the terms.

8. 8

   Legal Jurisdiction

   This agreement is governed by the laws of the Autonomous Region of Madeira, Portugal. Any legal claims or disputes will be exclusively handled by the courts of Funchal, Madeira.

9. 9

   Severability Clause

   If any clause in this agreement is found unenforceable, the remainder of the agreement shall remain valid and enforceable.

10. 10

    Parental / Guardian Consent (Minors)

    If minors are participating, I, the parent/legal guardian, confirm that I have read and accept these conditions and give full consent for my child to participate.

Insurance Coverage

I acknowledge that the activities I (and my group) will participate in are covered under a Group Personal Accident Insurance Policy issued by Allianz Portugal, policy number 207508223, valid from 03/01/2025 to 13/12/2025, with automatic annual renewal thereafter.

I understand that this coverage is limited in scope and does not eliminate all financial liability or risk. I remain personally responsible for any additional costs beyond those covered by the policy.

Release of Liability

I hereby release, waive, and discharge Desafio Catita Unipessoal Lda (Madeira Climbing Center), its owners, employees, contractors, and partners from all liability for injury, death, loss, or damage to personal property arising from participation in the above activities, except in cases of proven gross negligence or willful misconduct.
